Terms and Conditions of the Website and Online Store available at evanlite.com

I. DEFINITIONS

1. Seller, Data Controller – Lemonbike.eu Gabriela Fabian, VAT ID (NIP): 6311009288, REGON: 277495024, registered office: ul. Armii Krajowej 5, 44-120 Pyskowice, Poland, e-mail: info@evanlite.com
2. Store – the online store operated by the Seller, available at www.evanlite.com, through which the Buyer may place Orders.
3. Client, Buyer – a person using the Store and placing an Order via the Store. Buyers may be Consumers or Sole Traders.
4. Consumer – a natural person entering into a sales contract via the Store for purposes not directly related to their business or professional activity.
5. Sole Trader – a natural person entering into a sales contract via the Store directly related to their business activity, provided that the contract does not have a professional character resulting from the subject of that activity as disclosed in the Central Register of Business Activity.
6. Privacy Policy – a document describing the rules of personal data protection applied by the Seller, available in the “Privacy Policy” section of the Store.
7. Terms and Conditions – this document.
8. Product – a movable item available for sale via the Store.
9. Order – a declaration of intent by the Buyer aimed at concluding a distance sales contract for Products, specifying their type and quantity.
10. Business Days – Monday to Friday, excluding public holidays.
11. Evanlite – a bicycle wheel brand owned by the Seller, including all intellectual property rights. Evanlite is a legally protected and registered trademark. All rights reserved.

II. GENERAL PROVISIONS

1. These Terms and Conditions define the rules for concluding and performing sales contracts for Products offered in the Store.
2. To place an Order correctly, the Buyer must have access to an electronic device with Internet access, an active e-mail account, and sufficient technical resources enabling the proper display of websites.
3. The subject of sale are Products displayed in the Store at the time the Order is placed by the Buyer.
4. Product prices are displayed in Polish zloty (PLN), euro (EUR), and other local currencies supported by Shopify Payments, depending on the currency selected by the Buyer. Prices are gross prices and include VAT applicable at the time of concluding the sales contract.
5. The content of the Store constitutes an invitation to conclude a contract within the meaning of Article 71 of the Polish Civil Code and does not constitute a sales offer within the meaning of civil law provisions.
6. The Seller makes every effort to ensure accurate descriptions and images of Products corresponding to their actual condition; however, minor differences may occur due to display settings or human error. The Seller reserves the right to update Product data and specifications without prior notice.
7. The Seller undertakes to deliver Products in conformity with the sales contract, meaning free from physical and legal defects, in accordance with applicable law.
8. Pursuant to Article 14(1)–(2) of Regulation (EU) No 524/2013, Consumers have the right to use out-of-court dispute resolution via the ODR platform available at http://ec.europa.eu/consumers/odr

III. PLACING ORDERS

1. Orders may be placed via the Store order form, by telephone at +48 575 830 916, or by e-mail at info@evanlite.com.
2. Telephone call costs are charged according to the Buyer’s operator tariff.
3. To place an Order via the Store, the Buyer must add Products to the cart and complete the checkout process by selecting delivery and payment methods and providing delivery and billing details.
4. Clicking the final purchase button (e.g. “Pay now”) constitutes confirmation of acceptance of these Terms and Conditions and the Privacy Policy and results in the conclusion of a sales contract.
5. After placing an Order, the Buyer will receive an e-mail confirming acceptance or rejection of the Order. Acceptance constitutes conclusion of the contract.
6. Any discrepancies should be reported to info@evanlite.com without delay.
7. Until dispatch, the Buyer may request modifications to the Order, subject to the Seller’s approval.
8. Orders may also be placed by phone or e-mail following agreement on all terms.

IV. DELIVERY

1. The Seller delivers Products within Europe. Delivery costs are presented during checkout after entering the delivery address.
2. Delivery is carried out via courier services.
3. The Seller is responsible for proper packaging and bears the risk until delivery to the Buyer.
4. Dispatch times are stated on the Product page and apply to paid Orders.
5. The Seller may extend dispatch time by up to 14 days in justified cases.
6. Personal collection may be arranged individually with the Seller.

V. PAYMENT TERMS

1. Available payment methods depend on delivery location and selected currency.
2. Payments may be made via bank transfer, PayU, PayPal, or Shopify Payments (Bank Card, Klarna).
3. If payment is not received, the Seller may contact the Buyer or cancel the Order.
4. Failure to pay by bank transfer within 3 business days may result in cancellation.
5. Discount codes may be issued under specific conditions and are not exchangeable for cash or combinable unless stated otherwise.

VI. INSTALLMENT SALES

1. Buyers may choose installment payments via PayU, Klarna, PayPal installments, subject to approval by the financing institution.
2. The Seller is not a party to the credit agreement.
3. Credit conditions are determined solely by the lender.
4. Orders are processed only after positive credit approval.

VII. ORDER FULFILLMENT

1. The Seller may inform the Buyer about Order status via e-mail, SMS, or phone.
2. The Seller provides a fiscal receipt or VAT invoice with the Product.

VIII. SHIPMENT SECURITY AND INSPECTION

1. The Buyer should inspect the shipment upon delivery and prepare a damage report if necessary.
2. Proper documentation accelerates complaint handling.
3. The Buyer may refuse damaged shipments and notify the Seller.
4. The Seller bears responsibility until delivery to the Buyer.

IX. RIGHT OF WITHDRAWAL

1. Consumers and Sole Traders may withdraw from the contract within 14 days without giving reasons.
2. The withdrawal period starts from the day of receipt of the Product.
3. Customized Products are excluded from the right of withdrawal.
4. Returned Products must be sent within 14 days; return costs are borne by the Buyer.
5. The Seller refunds payments within 14 days, possibly reduced for diminished value.

X. COMPLAINTS – STATUTORY LIABILITY

1. The Seller is liable for non-conformity of Products in accordance with applicable law.
2. Complaints may be submitted electronically or in writing.
3. The Seller responds to complaints within 14 days.

XI. MANUFACTURER’S WARRANTY

1. Warranty claims may be submitted via e-mail or online form.
2. Warranty terms are available on the Store website.
3. Warranty rights do not exclude statutory rights.

XII. PERSONAL DATA PROTECTION

1. The Data Controller is the Seller.
2. Providing personal data is voluntary but necessary for Order processing.
3. Data may be shared with payment operators, couriers, hosting providers, banks, and service partners in accordance with GDPR.
4. Detailed rules are described in the Privacy Policy.

XIII. FINAL PROVISIONS

1. Matters not regulated herein are governed by applicable law.
2. Mandatory legal provisions prevail over these Terms and Conditions.

4. The Seller may amend the Terms for valid reasons; archived versions remain available.
5. Contracts concluded before amendments remain governed by the version applicable at the time of conclusion.
